Notification and Hearings

Advisors

An accused student/organization can choose an advisor to assist them during the conduct process. The advisor doesn’t have to be affiliated with NIU, but they should be knowledgeable about the university’s conduct process. Advisors:

  • Must not have been involved in the alleged incident
  • May not speak on behalf of the accused but may ask questions of procedure.
  • May confer with the accused during their hearing, though they’re not required to attend.

Hearings

All parties are entitled to a fair and impartial hearing with the ability to introduce information and witnesses, make statements and ask questions. No one will be required to provide information that may be self-incriminating.

The accused student/organization has the right to examine documents, statements and other evidence that will be presented at the hearing, as well as to be informed of the identity of witnesses.

The accused is presumed not responsible until proven responsible. In order to find the accused responsible, the evidence and testimony must show it’s more likely than not that they committed the violation.

Findings

After a decision is reached, Student Conduct will notify the accused student/organization and the victim (or survivor, in incidents of sexual misconduct) of the findings in writing within two business days.

The accused student/organization or the victim/survivor who receives an adverse decision can file an appeal of the findings and/or sanctions.

Records

The accused student (or the president of the accused organization) will receive copies of relevant correspondence and materials when they’re notified of an alleged violation. Accused students/organizations will continue to receive copies of related correspondence throughout the conduct process. Materials will be redacted as required by law.

Conduct Tip

If you’re notified of an alleged violation, you can submit your version of the alleged incident by completing a General Incident Report Form.
